📄 What are the types of contract in Colombia?

Work-by-work contract , which is carried out for a specific task and ends when it comes to an end. If the contract is terminated earlier, without just cause, the employer must pay the contractor compensation equivalent to the time remaining for the contracted work. Fixed-term contract , which must have a duration not exceeding three years and can be extended indefinitely when its validity is greater than one year. It can have two modalities: greater or less than one year. In the case of the first, if a trial period is established, it cannot be longer than two months, and in the case of the second, a prior notice of thirty days is required for its termination.

Indefinite term contract , which does not have a stipulated completion date or this does not require the nature of the service to be executed.

Apprenticeship contract , which is not properly an employment contract, but one through which a person has theoretical and practical training in an authorized entity, and for this he receives monthly support that is at least the equivalent of 50% of a current minimum wage.

Temporary , occasional or accidental contract, which is not very frequent in Colombia. It is a temporary contract for tasks other than normal activities for a period of no more than thirty days.

What is the minimum wage? The current legal monthly minimum wage (SMLMV) is agreed between the National Government, the employers and the unions. For 2021 it has been set at $ 908,526.

What is a transportation aid? It is a right that workers who earn between one and two minimum wages have. It is an aid so that the employee can be transported. It is set for 2021 at $ 106,454.

What are contributions? As a worker, you must make a contribution of 4% of your salary to have access to Health Promotion Entities, 12.5% ​​will be given by your employer. 1. Presentation of the resume and preselection. The resume, or "curriculum vitae", is the document in which the worker's profile is presented to a company.

3. Technical and psychotechnical tests. They are a series of tools with which companies measure the personality traits, behaviors, aptitudes, capacities and abilities of the worker. Knowledge tests can also be carried out to measure the applicant's levels of the needs of the position for which he is presenting.

4. The selection of the candidate. If the company has already chosen and evaluated your capabilities for the position, the process is on the right track, but it is not all over.

5. Presentation of certifications of studies, work and experience. The employer could ask the candidate to present documents that certify what they have put on their resume. It should be noted that in Colombia there is no regulation that requires the candidate to present the certifications of their experience. But in case they ask for it, and you do not have your legalized study certificate, you can validate your studies through an evaluation of the Ministry of Education, which has no cost. You just have to go to the headquarters of the Secretariat that is close to you.

7. Medical entrance exams. In this step, the employer will identify the physical and mental health conditions of the candidate. That is why you must attend a medical examination, but beware: they will not be able to request pregnancy or HIV tests, and these tests must be paid for by the employer depending on the type of contract.
